Welcome to EVPad Canada. These Terms of Service (“Terms”) govern your use of the EVPad Canada website, online store, products, and related services (collectively, the “Services”).
Throughout these Terms, “EVPad Canada,” “we,” “us,” and “our” refer to EVPad Canada.
By accessing our website, using our Services, or purchasing a product from EVPad Canada, you agree to these Terms and our applicable policies, including our Refund & Return Policy, Shipping Policy, Warranty Policy, Privacy Policy, and Third-Party Apps & Content Disclaimer.
If you do not agree with these Terms, please do not use our Services.
1. Online Store
You must be at least the age of majority in your province, territory, state, or jurisdiction of residence to make a purchase from our store, or have the permission of a parent or legal guardian where permitted by law.
You may use our website and products only for lawful purposes and in accordance with applicable laws and regulations.
You agree that the information you provide when placing an order is accurate, current, and complete.
2. Products
We make reasonable efforts to accurately describe and display the products available through our store.
Product specifications, packaging, appearance, features, and availability may change from time to time. Actual colours and appearance may also vary depending on the display or device used to view our website.
We reserve the right to modify or discontinue products and to limit quantities available for purchase.
3. Orders
When you place an order, you are making an offer to purchase the products in your order.
EVPad Canada reserves the right to accept, decline, or cancel an order where reasonably necessary, including in cases involving payment issues, suspected fraud, incorrect pricing or product information, inventory errors, or other circumstances that prevent us from fulfilling the order.
If we cancel an order after payment has been received, the applicable payment will be refunded.
Please review your order carefully before submitting it. We cannot guarantee that changes or cancellations can be made after an order has been processed or shipped.
Final Sale
All sales are final except as provided in our Refund & Return Policy, Warranty Policy, or as otherwise required by applicable law.
We do not accept returns or exchanges for change of mind, unwanted products, or compatibility issues.
Defective, damaged, or incorrect products may qualify for repair, replacement, refund, or another appropriate remedy in accordance with our applicable policies.
4. Prices and Payment
All prices displayed on EVPad Canada are in Canadian dollars unless otherwise stated.
Prices, promotions, discounts, and product availability may change without notice.
Applicable taxes and any shipping charges will be displayed during checkout where applicable.
You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method submitted with your order.
We reserve the right to correct pricing, product information, or other errors. If a material error affects an order you have already placed, we will contact you where appropriate.
5. Shipping and Delivery
Orders are shipped from Richmond, British Columbia, Canada.
Orders are typically processed and handed over to the carrier within 1 business day.
FREE Standard Shipping is available on orders within Canada. Express Shipping may be available for an additional charge displayed at checkout.
Shipping and delivery times are estimates and are not guaranteed. Delays may occur due to carriers, weather, holidays, customs, or circumstances outside our reasonable control.
Tracking information will normally be provided after an order has been dispatched.
If a shipment appears to be lost in transit or arrives damaged, please contact EVPad Canada so we can assist with the carrier investigation and appropriate resolution.

6. Local Pickup
Free local pickup may be available at our Richmond, BC location by appointment.
Customers selecting local pickup should contact EVPad Canada to arrange a pickup time and bring their order confirmation when collecting the order.
7. Refunds and Returns
All purchases are final sale and are not eligible for change-of-mind returns or exchanges.
7-Day Defective or Damaged Item Policy
Customers should inspect and test their products promptly after delivery.
If a product arrives defective or damaged, or if an incorrect product is received, the customer must contact EVPad Canada within 7 days of delivery.
We may first provide troubleshooting assistance to determine whether the issue can be resolved without returning the product.
If a return is required for an eligible defective or damaged product, or because EVPad Canada shipped an incorrect item, EVPad Canada will cover the applicable return shipping cost and provide return instructions.
Products must not be returned without prior authorization from EVPad Canada.
After receiving the returned product, we may inspect and test it to confirm the reported issue.
For an eligible claim, the appropriate resolution may include repair or replacement. If EVPad Canada is unable to provide an appropriate repair or replacement, a refund or other remedy may be offered where appropriate.
If a returned product is found to be functioning normally or the problem results from misuse, physical damage after delivery, unauthorized modification, or an excluded third-party application or service, the customer may be responsible for shipping costs associated with returning the product to them.

8. One-Year Limited Warranty
All products purchased directly from EVPad Canada are covered by a 1-Year Limited Warranty, beginning on the original delivery date.
The warranty covers defects in materials or workmanship arising during normal use.
The warranty does not cover:
- Accidental, physical, or liquid damage
- Misuse or improper installation
- Damage caused by an improper power supply
- Unauthorized modifications, repairs, or alterations
- Normal wear and tear
- Lost or stolen products
- Problems caused solely by third-party applications, services, accounts, subscriptions, internet connections, networks, or content availability
Customers must contact EVPad Canada before returning a product for warranty service. We may provide troubleshooting assistance before authorizing a warranty return.
For warranty claims made after the first 7 days, the customer is responsible for shipping the product to EVPad Canada.
For an approved warranty claim within Canada, EVPad Canada will cover the cost of shipping the repaired or replacement product back to the customer.
If a returned product is tested and no covered defect is found, the customer will be responsible for the cost of shipping the product back to them.
At our discretion, an eligible product may be repaired or replaced. If the same model is no longer available, we may provide a comparable replacement.
Warranty service does not automatically entitle the customer to a refund.
Nothing in these Terms or our Warranty Policy is intended to limit rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.

9. Third-Party Applications, Services and Content
EVPAD products are multimedia devices that may allow users to access the internet and install compatible applications.
Applications, streaming services, websites, accounts, content, and other third-party services are operated independently from EVPad Canada unless expressly stated otherwise.
EVPad Canada does not own, operate, control, or provide third-party applications, services, or their content merely because they can be accessed using a product sold by EVPad Canada.
The availability, functionality, compatibility, pricing, and content of third-party applications and services may change, become interrupted, or become unavailable without notice.
EVPad Canada cannot guarantee the continued availability or performance of any third-party application, service, channel, website, or content provider.
Certain third-party services may require separate accounts, subscriptions, purchases, or fees charged by their respective providers. Unless expressly stated otherwise, these are not included with the purchase of a product from EVPad Canada.
Changes, interruptions, removal, or incompatibility of third-party applications, services, or content are not considered hardware defects and are not covered by the EVPad Canada Limited Warranty.
10. Lawful Use and Intellectual Property
Customers are responsible for ensuring that their use of products, applications, services, and content complies with applicable laws, regulations, licensing requirements, and third-party terms of service.
EVPad Canada respects copyright and other intellectual property rights. Customers should only access, stream, download, distribute, or otherwise use content that they are legally authorized to use.
You may not use our website or Services for unlawful purposes or in a manner that infringes the intellectual property or other legal rights of EVPad Canada or any third party.
The EVPad Canada website and its original text, graphics, logos, designs, and other materials are protected by applicable Canadian and international intellectual property laws, subject to any rights owned by manufacturers, Shopify, or other third parties.
Third-party trademarks, product names, logos, applications, and service names remain the property of their respective owners.
11. Third-Party Links and Services
Our website may contain links to or integrations with websites, applications, payment services, or other services operated by third parties.
EVPad Canada does not control these third-party services and is not responsible for their content, policies, security, availability, or operation.
Customers should review the applicable terms and privacy policies of third-party providers before using their services.
12. Shopify
Our online store is powered by Shopify, which provides the ecommerce platform used to offer our products and Services.
Purchases from EVPad Canada are transactions between the customer and EVPad Canada. Shopify is not the seller of products purchased from EVPad Canada.
Certain information may be processed by Shopify as necessary to operate and provide our online store. Please refer to our Privacy Policy for additional information regarding the handling of personal information.
13. Privacy
Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable privacy laws.
By using our Services, you acknowledge that certain information may be processed by service providers, including Shopify and payment, shipping, analytics, and other providers used to operate our business.

14. Errors and Inaccuracies
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, pricing, promotions, shipping charges, transit times, inventory, or availability.
We reserve the right to correct errors and update information where reasonably necessary.
If a material error affects an order already placed, we may contact the customer to resolve the issue or cancel and refund the affected order where appropriate.

You may not use our website or Services:

Except for the EVPad Canada 1-Year Limited Warranty, other express warranties specifically provided by EVPad Canada, and rights or warranties that cannot be excluded under applicable law, the website and Services are provided on an “as is” and “as available” basis.
We do not guarantee that our website will always be uninterrupted, secure, error-free, or available.
Nothing in this section excludes or limits any warranty, condition, right, or remedy that cannot lawfully be excluded or limited.
17. Limitation of Liability
To the fullest extent permitted by applicable law, EVPad Canada will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of our website, Services, or products, including losses arising from third-party applications, services, or content.
This limitation does not apply where liability cannot lawfully be excluded or limited.
Nothing in these Terms is intended to exclude or limit rights or remedies available under applicable consumer protection laws where those rights cannot legally be waived.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless EVPad Canada and its employees, representatives, service providers, and affiliates from third-party claims, losses, or reasonable costs resulting from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights.
19. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement between you and EVPad Canada concerning your use of our Services and purchases from our store.
Failure by EVPad Canada to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, Services, policies, or applicable requirements.
The current version will be posted on our website. Where required by applicable law, we will provide additional notice of material changes.
22. Governing Law
These Terms and any separate agreements under which EVPad Canada provides Services are governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to applicable consumer protection laws, legal proceedings arising from these Terms or the Services will be brought before the courts of British Columbia, Canada.
